Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Classic Cars Arena website, services, and platform (collectively, the "Service") operated by Classic Cars Arena LLC ("Classic Cars Arena", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Classic Cars Arena is an online marketplace that connects buyers and sellers of classic vehicles. We provide listing tools, search functionality, editorial content, valuation references, and communication channels between users. We are not a party to any transaction between buyers and sellers. We do not own, sell, inspect, or take possession of any vehicle listed on the platform.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding contracts
  • You will comply with these Terms and all applicable laws
  • The information you provide is accurate, current, and complete

3. Account Registration

To list a vehicle, contact a seller, or use most platform features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately via our contact form if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Listings — Seller Responsibilities

If you list a vehicle on Classic Cars Arena, you agree to:

  • Be the legal owner of the vehicle, or be authorized by the owner to sell it
  • Hold clear title — no liens, no salvage history undisclosed, no stolen vehicles
  • Provide accurate descriptions — year, make, model, mileage, condition, modifications, known issues
  • Use authentic photos of the actual vehicle being sold (no stock photos, no images of similar vehicles)
  • Respond promptly to legitimate buyer inquiries
  • Honor the asking price or negotiate in good faith — no deceptive pricing schemes
  • Update or remove the listing when the vehicle sells

You retain ownership of your listing content but grant Classic Cars Arena a worldwide, royalty-free, non-exclusive license to display, reproduce, modify (for formatting), and distribute the content for the purpose of operating and promoting the Service, including in our sold archive and editorial content.

5. Listings — Buyer Responsibilities

Buying a classic vehicle is a high-value transaction. You agree to:

  • Conduct your own due diligence — verify VIN, title, mechanical condition, ownership history
  • Inspect the vehicle in person or hire a professional inspection service before completing a purchase
  • Verify the seller's identity and ownership before transferring funds
  • Use secure escrow or buyer-protection services for high-value transactions
  • Not rely solely on Classic Cars Arena listings, valuation estimates, or editorial content as the basis for a purchase decision

6. Prohibited Conduct

You may not, and may not permit any third party to:

  • List vehicles you do not own or are not authorized to sell
  • Provide false, misleading, or fraudulent information
  • List stolen, counterfeit, or salvage-titled vehicles without proper disclosure
  • Engage in price manipulation, shill bidding, or fake-bid schemes
  • Harass, threaten, or defraud other users
  • Send spam, unsolicited advertising, or off-platform redirection schemes through our messaging system
  • Scrape, copy, or republish our content (listings, sold archive, editorial) for competitive purposes
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Upload malware, viruses, or any code intended to damage the Service or other users
  • Bypass security measures, rate limits, or content access controls
  • Use the Service to violate any applicable law or regulation

7. Paid Services and Payments

Some features (Featured Listings, Premium Listings, Dealer Programs) require payment. By purchasing a paid feature, you agree:

  • Payments are processed by third-party providers (Stripe, PayPal); their terms also apply
  • All fees are quoted in U.S. Dollars (USD) and are non-refundable except as required by law or expressly stated
  • Listing visibility upgrades begin at activation and run for the period purchased; we do not refund unused time if your vehicle sells early
  • We may change pricing for new purchases; changes will not affect already-active subscriptions
  • Failed or disputed payments may result in suspension of paid features or your account

8. Intellectual Property

The Service, including its design, code, editorial content, branding, logos, and the compilation of listings, is owned by Classic Cars Arena and protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission, except as expressly permitted by these Terms or applicable law.

8.1 DMCA / Copyright Complaints

If you believe content on the Service infringes your copyright, submit a written notice via our contact form including:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material with the URL where it appears
  • Your contact information (address, phone, email)
  • A statement that you have a good-faith belief that the use is unauthorized
  • A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner's behalf

We will investigate and respond per the Digital Millennium Copyright Act (DMCA). Repeat infringers will have their accounts terminated.

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy of any content. We do not warrant that:

  • Listings are accurate, complete, or current
  • Sellers are authorized to sell the vehicles listed
  • Vehicles are as described, free from defects, or have undisclosed history
  • Valuation estimates reflect any specific vehicle's actual value
  • The Service will be uninterrupted, error-free, or secure

10. Limitation of Liability

To the maximum extent permitted by law, Classic Cars Arena, its officers, directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from or related to your use of the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim related to the Service shall not exceed the greater of (a) the total fees you paid to Classic Cars Arena in the 12 months preceding the claim, or (b) one hundred U.S. dollars (USD $100).

11. Indemnification

You agree to indemnify and hold harmless Classic Cars Arena and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your listings or content, (c) your violation of these Terms, (d) your violation of any third party's rights, or (e) any transaction you enter into with another user.

12. Termination

You may terminate your account at any time via your account settings or by contacting us through our contact form. We may suspend or terminate your access to the Service, with or without notice, for any violation of these Terms or for any conduct we determine to be harmful to other users or the Service. Termination does not relieve you of obligations accrued before termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be resolved by binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association — except that either party may bring qualifying claims in small-claims court.

You waive any right to participate in a class action against Classic Cars Arena to the maximum extent permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Site at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

15. Miscellaneous

  • Entire agreement — these Terms, together with our Privacy Policy and other linked policies, constitute the entire agreement between you and Classic Cars Arena
  • Severability — if any provision is found unenforceable, the remaining provisions remain in effect
  • No waiver — failure to enforce any right does not constitute a waiver
  • Assignment — you may not assign these Terms; we may assign them in connection with a corporate transaction
